NDMC Grants Deemed Health Trade License to FSSAI & GST Registered Food Businesses

New Delhi — In a significant move to simplify compliance for food businesses, the New Delhi Municipal Council (NDMC) has announced that valid FSSAI and GST registrations will now be treated as deemed Health Trade Licenses under its jurisdiction. The reform aims to reduce duplication in licensing and support the Government’s Ease of Doing Business and Ease of Living initiatives.

Why NDMC Introduced This Change

Previously, food businesses operating within NDMC limits had to obtain:

  • FSSAI registration or license
  • GST registration, wherever applicable
  • A separate Health Trade License from NDMC

However, since FSSAI already regulates food safety and GST registration confirms business legitimacy, NDMC recognized that a separate municipal license created unnecessary overlap. The new deemed approval mechanism removes this duplication while maintaining regulatory oversight.

What the Order States

According to the NDMC order:

  • FSSAI licenses and registrations under Section 31 of the Food Safety and Standards Act, 2006, now act as deemed Health Trade Licenses.
  • GST registration under Section 22 of the CGST Act also qualifies as deemed approval under municipal provisions.
  • Existing establishments holding valid FSSAI or GST registration no longer need to apply separately for an NDMC Health Trade License.
  • The order takes effect immediately.

This relief applies to businesses operating within NDMC jurisdiction that:

  • Hold a valid FSSAI registration or license
  • Maintain valid GST registration, wherever required
  • Continue complying with health and sanitation standards
  • Failure to meet these conditions may result in enforcement action.

Compliance Obligations Remain

NDMC emphasized that while the separate license requirement has been removed, compliance standards remain unchanged. Inspection teams will continue to monitor hygiene, sanitation, and public safety. Businesses must maintain proper sanitation practices and documentation, as deemed approval does not provide immunity.
