The Madras High Court has stayed the suspension of a KFC outlet’s license

The Madras High Court has issued an interim stay on the suspension of a KFC outlet’s license in Thoothukudi district, Tamil Nadu. The suspension was initially imposed due to allegations of using Magnesium Silicate Synthetic in cooking oils.

The court highlighted procedural issues, including the immediate suspension without prior improvement notice, which contravenes the Food Safety and Standards Act of 2006. The court noted that certain regulations about oil reuse were advisory rather than mandatory, and directed authorities to avoid punitive actions for unnotified processing aids.
